The “doctrine of precedent”, or stare decisis (Latin for “to stand by choices”) implies that selections by larger courts bind lower courts to assure that similar circumstances reach related outcomes. Hegel believed that civil society and the state have been polar opposites, within the scheme of his dialectic concept of history. The fashionable dipole state–civil society was reproduced in the theories of Alexis de Tocqueville and Karl Marx.
